Warranty Policy

This Warranty Policy describes the warranty terms for products sold by Nabryx Performance ("Nabryx Performance," "we," "us," "our"). Please read it carefully before purchasing. It is made available to you before purchase, consistent with the federal Magnuson-Moss Warranty Act and FTC pre-sale availability rules.

DRAFTING NOTE FOR COUNSEL/CLIENT (remove before publishing): Choose ONE structure below. Option A = Nabryx offers its own Limited Warranty. Option B = Nabryx passes through the manufacturer's warranty and offers no separate Nabryx warranty. The Magnuson-Moss Warranty Act requires any written warranty on a consumer product over $15 to be titled "Full" or "Limited," disclosed clearly, and available pre-sale. Implied warranties generally may not be disclaimed where a written warranty is given, though their duration may be limited to the written-warranty term where NJ law allows.

OPTION A: Nabryx Performance Limited Warranty

1. Coverage

Nabryx Performance warrants that covered products will be free from defects in materials and workmanship under normal use for [WARRANTY LENGTH, e.g., 12 months / limited lifetime] from the date of delivery to the original purchaser. This is a LIMITED WARRANTY.

2. Who Is Covered

This warranty extends only to the original retail purchaser and is non-transferable. Proof of purchase (order number) is required for any claim.

3. What Is Covered

Manufacturing defects in materials or workmanship of the product as originally supplied.

4. What Is NOT Covered

This warranty does not cover:

• Finish, coating, discoloration, bluing, heat tint, or cosmetic changes resulting from normal heat exposure and use (this is characteristic of performance exhaust systems);
• Damage from improper or non-professional installation, misuse, abuse, accident, collision, or negligence;
• Off-road, racing, competition, or track use, or any use inconsistent with the product's intended application;
• Normal wear, corrosion from road salt/environment, or damage from road debris;
• Products that have been modified, cut, welded, re-coated, disassembled, or repaired by anyone other than us or an authorized party;
• Improper fitment where the buyer selected the wrong application (buyer is responsible for fitment verification);
• Labor, installation, removal, re-installation, towing, diagnostic, rental, or consequential costs (see Section 7);
• Products not purchased directly from Nabryx Performance or an authorized reseller.

5. How to Make a Claim

1. Email contactnabryx@gmail.com with your order number, a description of the defect, and photos.
2. If approved, we will provide return instructions and, at our option, repair, replace, or refund the defective product.
3. [WHO PAYS WARRANTY SHIPPING, e.g., Nabryx covers return shipping for approved defect claims; buyer pays diagnostic returns that are found non-defective, CONFIRM.]

6. Remedy

Our sole obligation under this warranty is, at our discretion, to repair, replace, or refund the covered product. Replacement parts are warranted for the remainder of the original warranty period.

7. Limitations

TO THE FULLEST EXTENT PERMITTED BY LAW, NABRYX PERFORMANCE IS NOT LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LABOR, INSTALLATION, DIAGNOSTIC, TOWING, RENTAL, LOSS OF USE, OR VEHICLE DAMAGE. Any implied warranties, including merchantability and fitness for a particular purpose, are limited in duration to the term of this written warranty, except where New Jersey law does not permit such limitation. Some states/jurisdictions do not allow limitations on how long an implied warranty lasts or the exclusion of incidental/consequential damages, so the above may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state.

OPTION B: Manufacturer Warranty Pass-Through (Nabryx offers no separate warranty)

1. No Separate Nabryx Warranty

Nabryx Performance does not provide its own product warranty. Products are sold "AS IS" to the extent permitted by law, except that any applicable manufacturer's warranty is passed through to you.

2. Manufacturer Warranty

Where the product manufacturer provides a written warranty, that warranty (and its terms, coverage, exclusions, and claim process) governs. We will provide the manufacturer's warranty terms on request and assist you in initiating a manufacturer claim. Warranty coverage, if any, is provided solely by the manufacturer.

3. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, NABRYX PERFORMANCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXCEPT ANY NON-WAIVABLE WARRANTIES REQUIRED BY LAW. Nothing here limits your non-waivable rights under the New Jersey Consumer Fraud Act or the federal Magnuson-Moss Warranty Act.

Common Provisions (apply to whichever option is selected)

Effect on Vehicle / OEM Warranty

Installing aftermarket parts may affect or void portions of your vehicle manufacturer's warranty. Under the federal Magnuson-Moss Warranty Act, a vehicle manufacturer generally cannot void your entire vehicle warranty simply because you installed an aftermarket part; however, a manufacturer may deny warranty coverage for damage actually caused by an aftermarket part or its installation. You are responsible for understanding how our products may affect your vehicle warranty.

Off-Road / Competition Products

Many of our products are designated for off-road, closed-course, or competition use only. Use of such products on public roads may be unlawful and will void any warranty and any assurance of legality. See our Product Disclaimers.

Fitment and Installation

Warranty coverage assumes correct product selection for your vehicle application and professional installation. Improper installation or incorrect fitment selection voids warranty coverage.
