These Product Disclaimers apply to all products sold by Nabryx Performance ("Nabryx Performance," "we," "us," "our"). They are incorporated into our Terms of Service. By purchasing, you acknowledge that you have read and agree to these disclaimers. Our products are high-performance aftermarket parts. Please read carefully before you buy or install any product.

1. Off-Road / Competition Use Only

Many of the products we sell, including certain exhaust systems, downpipes, catless or high-flow-catalytic components, race pipes, valved exhausts, and tuning-related parts, are designed and sold for off-road, closed-course, and competition use only. Products so designated are not legal for use on public streets or highways and may not comply with federal or state emissions and noise laws.

By purchasing a product designated for off-road/competition use, you represent and certify that:

• You will use the product solely for off-road, closed-course, or competition purposes on vehicles that are not operated on public roads; and
• You are solely responsible for compliance with all applicable federal, state, and local laws.

2. Emissions Compliance: Clean Air Act and EPA

Under Section 203 of the federal Clean Air Act (42 U.S.C. §7522) and EPA policy, it is unlawful to manufacture, sell, install, or use any part that bypasses, defeats, or renders inoperative an emissions-control device or element of design on a vehicle certified for on-road use ("tampering" / "defeat devices"). We do not sell products for the purpose of tampering with emissions-control systems on street-driven vehicles. You are responsible for ensuring that any part you purchase and install complies with the Clean Air Act and EPA regulations for your intended use. Installing emissions-related off-road parts on a vehicle used on public roads may violate federal law and expose you to substantial penalties.

3. California CARB Requirements

California law (California Vehicle Code §27156 and 13 CCR §2222) prohibits the sale, installation, or use of aftermarket parts that modify or bypass emissions-control systems on vehicles operated on California roads unless the part has a California Air Resources Board (CARB) Executive Order (EO) exemption for that specific application, or the part is used exclusively on racing vehicles on closed courses.

• We do not sell or ship emissions-related parts that lack a CARB EO to California addresses or residents. We may screen, decline, or cancel and refund such orders based on your billing/shipping address.
• Where a product carries a CARB EO number, it will be identified on the product page. Absence of a CARB EO means the part is not legal for street use in California.

4. Noise / Sound-Level Legality

Aftermarket exhaust systems can increase vehicle sound levels. Federal law (Noise Control Act; 40 CFR Part 205) and many state and local laws regulate exhaust noise (commonly capping passenger-vehicle exhaust around 95 dB under specified test methods, with functional-muffler requirements). Products designated for off-road/competition use may exceed legal on-road sound limits. You are responsible for ensuring that your vehicle's sound level complies with the laws of your jurisdiction.

5. Legality Varies by Jurisdiction

Whether a given part is legal for street use depends on your vehicle, your state, and your locality. A part legal in one jurisdiction may be illegal in another. We make no representation that any product is legal for on-road use in your jurisdiction. It is your responsibility to determine and comply with applicable laws before purchase, installation, and use.

6. Fitment and Application

Product fitment and application information is provided as a guide and may contain errors. You are solely responsible for verifying that a product fits and is appropriate for your specific vehicle (make, model, year, engine, trim, and configuration) before purchasing and installing. If you are unsure, contact contactnabryx@gmail.com before ordering. Incorrect fitment selection is not a defect and may void warranty and return eligibility.

7. Installation at Your Own Risk

Our products should be installed by a qualified, professional technician following the manufacturer's and industry-standard procedures. Improper installation can cause property damage, personal injury, vehicle damage, fire, or death. Installation is at your own risk. We are not responsible for installation, labor, diagnostic, or removal costs, or for damage or injury resulting from installation or use. Always allow exhaust components to cool and follow all safety precautions.

8. Effect on Vehicle Manufacturer Warranty

Installing aftermarket parts may affect or void portions of your vehicle manufacturer's warranty. Under the federal Magnuson-Moss Warranty Act, a manufacturer generally cannot void your entire vehicle warranty solely because an aftermarket part was installed, but it may deny coverage for damage actually caused by the aftermarket part or its installation. You accept responsibility for any impact on your vehicle warranty.

9. Assumption of Risk; Release

High-performance driving and vehicle modification are inherently risky. To the fullest extent permitted by law, you assume all risk associated with the purchase, installation, and use of our products, including use on closed courses and in competition, and you agree to release and hold harmless Nabryx Performance from claims arising out of such use, misuse, unlawful on-road use of off-road products, or improper installation, except to the extent such release is not permitted by applicable law.

10. No Guarantee of Performance Results

Any performance figures, horsepower/torque estimates, sound descriptions, or similar claims are approximate and depend on vehicle configuration, tuning, conditions, and installation. Actual results may vary and are not guaranteed.

11. Limitation of Liability

Your remedies and our liability are limited as set out in our Terms of Service and Warranty Policy. Nothing in these disclaimers limits any rights you have that cannot be waived under the New Jersey Consumer Fraud Act, the Magnuson-Moss Warranty Act, or other applicable law.
