Chargeback Policy

This Chargeback Policy explains how Nabryx Performance ("Nabryx Performance," "we," "us," "our") handles payment disputes and chargebacks. Because we sell high-value performance parts, we ask customers to contact us first so we can resolve issues quickly and fairly. Nothing in this Policy limits any rights you have under card-network rules or applicable law.

1. Contact Us Before Disputing a Charge

If you have a problem with an order, a delay, a damaged item, a return question, or an unexpected charge, please contact contactnabryx@gmail.com before filing a chargeback with your bank or card issuer. Most issues (refunds, replacements, delivery questions) can be resolved directly and faster than the formal dispute process. Filing a chargeback for an issue we could have resolved ("friendly fraud" or first-party misuse) can delay your resolution.

2. What a Chargeback Is

A chargeback is a payment reversal initiated through your card issuer. Legitimate chargebacks (for genuine unauthorized transactions or unresolved problems) are a consumer protection we respect. However, chargebacks filed instead of following our Return, Cancellation, or Warranty process, or for items that were delivered as described, are disputes we may contest.

3. Our Response to Disputes (Representment)

When a chargeback is filed, we may submit a response ("representment") to the card network with supporting evidence, which may include:

  • Order details and your acceptance of our Terms and policies at checkout;
  • Proof of shipment, tracking, and delivery/proof of delivery;
  • Communications with you;
  • AVS/CVV and fraud-screening results and device information;
  • Documentation showing the product was delivered as described and any return/warranty terms.

We retain these records for a rolling period to support dispute resolution.

4. Fraud Prevention and Verification

To protect against fraud on high-value orders, we may:

  • Verify billing/shipping details and require address (AVS) and card-verification matches;
  • Request additional identity or payment verification before shipment;
  • Hold, decline, or cancel and refund orders that fail verification or are flagged as high-risk.

Orders may be processed through Shopify's fraud-analysis tools and, where applicable, Shopify Protect. Certain dispute types (for example, "item not received," "item not as described," and certain friendly-fraud reason codes) may not be eligible for Shopify Protect coverage; those are handled under this Policy.

5. Chargebacks on Off-Road / Restricted Products

By purchasing products designated for off-road, closed-course, or competition use only, you acknowledge our Product Disclaimers. Disputes premised on the legality of such products for on-road use, where you certified intended use and legal compliance at purchase, will be contested with your acknowledgment as evidence.

6. Abandoned or Returned Deliveries

If a package is refused, returned as undeliverable due to an incorrect address you provided, or abandoned, any resulting fees may be deducted from your refund consistent with our Return Policy. Filing a chargeback does not waive our right to apply applicable restocking or return-shipping charges permitted by law.

7. Resolution and Your Rights

We aim to resolve every legitimate concern. Pursuing our Return, Cancellation, or Warranty process is usually faster than a chargeback. This Policy does not limit your rights under card-network rules, the New Jersey Consumer Fraud Act, or other applicable consumer-protection law.
